Last month, USPTO Director Andrei Iancu announced proposed rulemaking to change the PTAB claim construction standard. Recent action hints that indefiniteness may be the next area for possible change.

Last August the USPTO had intervened in the Federal Circuit case of Tinnus Enterprises LLC v. Telebrands Corp., arguing for the Packard standard (over Nautilus), but more recently asked to withdraw from the appeal because the USPTO is "actively considering" -- along with claim construction -- the PTAB's "approach to indefiniteness."

Does this action indicate that indefiniteness is the next area for possible revisions in rulemaking? Stay tuned.
